GENERAL CONDITIONS OF USE - DRIVERS

For the services provided by the Society Cooperative des Chauffeurs VTC Independents (SCCVI), you may be required to accept special conditions which govern your use of these services. Please read these terms carefully. This includes information about the Service and your rights, as well as other important information. The SCCVI pursues an ideal objective of guaranteeing decent living conditions that respect the laws of the canton of Geneva and the federal government for its members, mainly VTC drivers. In this context, it can seek to convince its members of their superior interest to its duty to achieve its social purpose. The members of the SCCVI are independent in terms of social insurance, the persons who work in their name and on their own account are independent in their work and bear the economic risk. The independents have their own brand (exclusive specialty), their own infrastructure, issue invoices in their own name, bear the risk of collection and carry out the VAT declaration. Aim

  1. The purpose of the cooperative society is to promote and offer its members the possibility of carrying out an activity as an independent VTC driver under excellent conditions and in their own interest.

  2. These include the establishment and operation of a digital platform for broadcasting races in the interest of its members and socially responsible.

  3. This presupposes conditions for registering on the platform and for using the platform offering maximum autonomy to its members, while respecting public security, public order, the environment, rules relating to for the use of the public domain, the fairness of commercial transactions, price transparency as well as compliance with regulations on working conditions, social standards and the fight against undeclared work.

  4. For the execution of its object, the cooperative of independent drivers of VTC (SCCVI) collaborates with the competent authorities and with all the institutions supporting its objectives. The cooperative society may carry out other activities which are linked to the aim of the cooperative society or which promote its aim directly or indirectly.

II. ACQUISITION OF MEMBERSHIP

  1. Admission requirements 1 All persons who, Cumulatively:

    1. Fulfill the cantonal and/or federal conditions for the exercise of the activity of VTC driver;

    2. Have cantonal and/or federal authorizations to exercise the activity of VTC driver;

    3. Comply with the cantonal and/or federal conditions for exercising the activity of

      VTC driver, i.e. in particular the obligations relating to the vehicle, road traffic and customers;

    4. Not compromise the purpose of the cooperative society.

       

  2. Admission procedure

  1. The candidate must send his request in writing to the SCCVI recruitment committee. The committee May require the production of documents proving compliance with the admission conditions.

    The committee decides on the acceptance or refusal of the request. Deliberations take place behind closed doors. The committee is not required to justify its decision.

  2. In the event of acceptance, the acquisition of membership remains subject to full payment of the share and the entry fee (100. - CHF).

  3. Membership is acquired on the date of full payment of the share and registration fee.

III. LOSS OF MEMBERSHIP

3- Principle

1 Membership is lost:

  1. By resignation;

  2. Upon the death or dissolution of the member;

  3. By exclusion or forfeiture;

  4. By transfer of the share;

  5. By the dissolution of the cooperative society.

    Basic principles

    1. The Super Chauffeur Application/Web/Telephone puts you in touch with the Users and thus allows you to have the possibility of offering Races in Switzerland.

    2. Super chauffeur connects Drivers with Users, in accordance with federal and cantonal regulations in Switzerland.

    3. You are directly bound by a transport contract with Users when you carry out errands on their behalf.

    4. You accept the present Conditions of the cooperative society of independent VTC drivers in the transport of quality people on a professional basis. You are free to choose if, when and where you use the Super Chauffeur/Web/telephone application.

    5. You have the right to terminate these General Conditions of Use by notifying the Society Cooperative des Chauffeurs VTC Independents as described below:

       

      1. Object of the contract

        Each independent VTC driver to use our Super Chauffeur Application / Web / Telephone exchange platform must be a member of the SCCVI.

        These general conditions of use (hereinafter the "Terms of Use") govern the access and use of the APP / Web / Telephone exchange operated by the Cooperative Society of Independent VTC Drivers (CHE- 265.559. 058, hereinafter: the Cooperative) located in Geneva (Route de Veyrier 54, 1227 Carouge GE).

        The use of the APP/Web/CT Super Chauffeur (hereinafter “the Application/CT and Web”) is subject to acceptance of these Terms of Use.

        The service provided consists of the provision through the Application / Web / telephone exchange of a connection platform allowing third-party transport providers registered as users of the Super Chauffeur application (hereinafter: after "the Driver(s)" or

        “You”) to offer their journeys to people looking for a transport service (hereinafter “the Customer(s)”); the latter can, via the Super Chauffeur platform, transmit their race orders directly to the Chauffeurs.

        The App/Web/CT is intended for transport cars with driver used for the professional transport of people (hereinafter "the VTC(s)").

        By using the App/Web/CT and its services, you are informed that our platform, the Super Chauffeur application, connects drivers and customers and does not provide transport services. The Drivers who are members of the Cooperative provide transport services for their own account and under their own responsibility, in complete independence. Each journey made by a Driver for a Client will constitute a separate contract concluded directly between these persons alone.

        These T&Cs can be consulted at any time in the "Help" section of the application or on the website www.sccvi.com

        Any modification of these Terms of Use will be clearly communicated to users by the SCCVI after the General Assembly by vote of all the members of the SCCVI and you are free to accept or refuse them formally in order to proceed with the use of App/Web/ CT. Depending on their importance (price, operating conditions, etc.), they must be discussed and approved in assembly within the SCCVI.

        The SCCVI undertakes that any modification of the Conditions of Use will always guarantee the independence of the drivers (members of the SCCVI), ensure them an imputed income without commission and dignity in their activities, in the respect of ethics. And the law. .

        By accepting these General Conditions of Use, you choose to be independent when using the App/Web/CT Super Chauffeur. These General Conditions of Use do not create a common company, do not confer any mandate on the part of SCCVI, and do not authorize you to present yourself as an employee, worker, agent or legal representative of SCCVI.

      2. App/Web/CT Terms of Service

        1. Eligibility

          You are under no obligation to log in or use the App/Web/CT Chauffeur. You can log in to The App/Web/CT Chauffeur if, when and where you want.

          To use our App/Web/CT Super Chauffeur platform, you must hold a professional driver's card or any other authorization allowing you to exercise the activity of Taxi Driver or VTC in a professional capacity in accordance with the applicable legislation. . .

          The Cooperative will ask you to provide the following documents (mandatory by law) when registering on the platform:

          • Copy of your membership in the VTC driver’s cooperative of the canton of Geneva, dated and signed;

          • A valid mobile phone number;

          • Your recent photo ID in passport format;

          • Your work permit; (valid)

          • Your driving license 121 double-sided; (valid)

          • Your AVS / health insurance card; (valid)

          • The gray card of your vehicle mentioning the possibility of transporting people on a professional basis; (valid)

          • Your VTC card; (valid)

          • Your Geneva airport transport badge; (valid)

          • Your certificate of affiliation to a compensation fund (self-employed status) or (proof of the application for affiliation in progress), (valid)

          • Your VAT number;

          • Your personal address.

          To use the platform and receive your payments, you must also have an account on a payment platform compatible with the Super Chauffeur platform.

        2. Driver account

          The use of the App/Web/CT requires the installation of the software and your registration as a user (hereinafter the "Driver Account"). The opening of this Driver Account implies that you provide the Cooperative with all personal data such as your surname and first name, address, scan of your identity document, your professional Taxi or VTC card, driving license for your vehicle, a photo of you, your legal e-mail address, your telephone number, your certificate of independent activity (or proof of the application for affiliation in progress), and consent to their processing.

          You will also need to provide your bank details or/and credit card details before you can use the platform. The SCCVI may be required to request the communication of additional information or documents in the event that the information or documents that you have communicated are difficult to read, erroneous or that additional verifications are necessary for legal purposes. The use of the Application by the Driver is subject to the communication of all the documents and information required by these Conditions of Use. You certify that all registration information provided to SCCVI is accurate and you agree.

          Update this information in a timely manner. The responsibility of the SCCVI is not engaged if a Driver would have entered incorrect payment information and bank details. Without accurate, complete, and up-to-date information, you may no longer be able to access the service.

          The e-mail address you provided when registering will be used for communication purposes with the SCCVI will also be your means of communication with your Clients. Every ride invoice you issue through the App/Web/CT for your customers will be emailed to them automatically with your first and last name as the sender information and your email address as the reply-to address. For complaints, your Customers will be able to contact you directly via this e-mail address (for example by answering the billing e-mail) or your telephone number. Neither the SCCVI nor any possible subcontractor will have access to these communications between you and your Customers because they are made outside of the App/Web/CT.

        3. Multiple vehicles and carpooling with a Partner Driver

          Subject to all legal requirements being met, you may register multiple vehicles under your Driver Account and also share your vehicle(s) with other Drivers. Before any use, the Driver will make sure to indicate in the App/Web/CT in which vehicle he is.

        4. Driver behavior

          You agree not to authorize another person to use your driver account, to ensure the reliability and confidentiality of your identifiers or passwords and to comply at all times with the laws and regulations applicable to the professional activity of car transport Particular.

          The SCCVI may suspend or terminate this contract, in particular in the event of fraud, unlawful behavior or non-compliance with the law by the driver (for example, withdrawal of the driver's license, fraud, misconduct, gross negligence and etc.).

          The SCCVI Disciplinary Commission, constituted according to the rules adopted by the SCCVI assembly, to take any decision pursuant to this article.       3. Data protection policy

        At SCCVI, we take the privacy and security of our users' information very seriously. When using the App/Web/CT, SCCVI will access and collect personal data about you only when you are logged into the App/Web/CT (Online).

        In order to benefit from a good user experience, and so that the real geolocation data of the races that you carry out for your Customers via the App/Web/CT are correctly reflected in the calculations of the effective costs of the race, we recommend that you 'allow, in the settings of

        Your phone, the Application to access your location data at any time. Thus, even if you temporarily use a third party application during a race (for example a Google Maps type application to guide you on the course), the Application can continue to follow you and calculate the real distance covered during the race. .

        Otherwise, the race distance recorded by the Application could not accurately take into account the distance actually covered in the race (because this data would not be accessible when the Application is in the background). The SCCVI cannot, in such a case, be held responsible in the event of a calculation error linked to the impossibility of locating you throughout the duration of the race.

        Driver geolocation data is only accessible and collected by our platforms when you are “Online”. Access to and collection of geolocation data stops when you indicate to the Application that you are "Offline".

        The way in which the SCCVI processes personal data collected during the use of the Application, when creating a Driver Account or in any other way is described in the Privacy Policy accessible in the "Help" section of the 'Application or on the website www. scvi.ch

        The Privacy Policy is an integral part of these Terms of Use.

      4. Operation of our platform and race order By the Client, telephone exchange, WEB site, your private clients.

        1. Pricing

          The details of the prices can be consulted from the application and are updated by the members of the cooperative society of independent VTC drivers. (SCVI).

        2. Service Fees.

          1. You pay no service fees and the customer pays.

          2. Value Added VAT will be payable and will be included in the general rate.

          3. You pay an annual subscription of CHF 200. - To the SCCV set by the members of the SCCVI.

            1. Race request

              If your vehicle is available and meets the criteria required by a customer, your vehicle will be offered to them in the list of available vehicles. On your screen you can see all customer requests and you are free to accept any ride you want. You receive reservation requests via the app/web/CT and you can see the details (price, distance, pick-up location, and destination and ...) and you can accept or refuse and plan your work program.

              If the customer chooses your vehicle, the Application will inform you of this and will indicate the pick-up location, the estimated distance to get there, the destination address as well as the estimated price of the trip in the form of a price range.

              If the destination of the journey is abroad (ie outside of Swiss territory), the request will clearly indicate the country of destination.

              If the pick-up location is at an Airport, the Application will increase the amount of the pick-up according to the Regulations on the conditions of access to the perimeter of the Airport in question, and these costs will be displayed in the request racing filter.

              You will have 10 to 15 seconds (at the choice of the SCCVI) to choose to accept or refuse the race. This delay is based on how long the customer is willing to wait for a response from a driver (for example, when calling a driver on the phone and getting no response).

              As soon as you accept the race, the Customer will receive a confirmation of this race and will see your first name, professional card number, photo, the registration number of your vehicle, your geolocation and the indication (I am on my way).

              Your acceptance of the race implies that a contract is concluded between you and the Customer relating to the race ordered in your vehicle and the price range submitted to it.

              From the moment you accept the race, you are put in contact with the customer with whom you directly conclude a transport contract. The SCCVI connects only.

              You will see on your screen the first name, the photo if there is one, the method of payment of the

              Customer, and the place of care of the Customer and may contact the latter by telephone or by message. The Client can do the same with you. Telecommunications transmitted by the telephone network such as calls and sms generate costs borne by the issuer.

              When you arrive at the pick-up location, you will inform your Client via the Application that you have arrived. When the race has started (customer in the car with you), the customer will see your name, surname, business card number, photo and phone number.

              If you refuse the trip because you are no longer available – which you can do freely – the Customer can select and order another vehicle from his list.

            2. Cancellation of the order / cancellation costs

              The customer can cancel an order at any time before the start of the race.

              Any order cancellation by the customer more than 4 minutes after its acceptance by the Driver will give rise to cancellation fees and the Driver will receive cancellation fees equivalent to a minimum amount set by SCCVI members in AG. The Customer will be informed via the Application.

              The cancellation of an order also covers the situation in which the Customer does not appear in front of the vehicle ordered within 5 minutes from the moment when you informed the Customer via the Application of your arrival at the pick-up location in charge. You will then have the right to cancel the race and collect cancellation fees equivalent to a minimum amount decided by the SCCVI. The Customer will be informed of this through the Application, however if the Driver is more than 5 minutes late at the pick-up location compared to the time initially estimated by the application, the cancellation by the Customer will not generates no cancellation fees. . You agree that no cancellation fees will be charged to the Customer if the latter cancels his race less than 4 minutes after your acceptance of the race (often a handling error).

            3. Driver Waiting / Waiting Charges

              If the Customer does not appear in front of the vehicle ordered 2 minutes after your arrival at the pick- up location, a waiting fee of CHF 0.50 per additional minute will start to run and will be added to the price of the journey. The Customer will be systematically informed of this through the Application. You agree that disabled or elderly customers will not be charged for the first 6 minutes. If a disabled or elderly customer does not show up in front of the vehicle ordered within 6 minutes of your arrival at the pick-up location, a waiting fee of CHF 0.50 per additional minute will be added to the price. The customer's race will be systematically informed via the Application.

            4. Receipt for cancellation fees

              Any cancellation fee, like the price of a trip, will be the subject of a receipt which will be notified to the Customer as soon as possible and which can also be consulted via the Application.

            5. Complaints

          In the event of complaints about a trip, its invoicing or the service provided, Drivers and Customers will have the possibility of contacting each other directly by telephone (call or SMS) or by e-mail in order to find an amicable solution (reimbursement via the Application, apologies, etc.) or, if necessary, to take the necessary measures towards each other (complaint, etc.).

      5. Estimation of travel time and distance of races on our Super Chauffeur platform

        Chauffeur uses a mapping system to predict distances and times between:

        • The position of the customer, the place of pick-up and the place of arrival, and

        • The position of the driver and the customer as well as the places of arrival and pick-up. The accuracy of distance and travel time estimation is mainly determined by two factors:

        • The accuracy of the mobile network – and the uncertainty inherent in this criterion;

        • The precision of the cartographic system and the uncertainty of this precision.

          Either way, the app will generate estimated distances and times. These estimates will vary at any time according to the following criteria:

        • The precision of the cartographic platform as to the route it chooses as being the fastest route. Some trips may be made with different routes at different times, depending on traffic variables, such as accidents, roadblocks or traffic jams that the mapping platform may or may not detect.

        • Quality of the mobile network used (location/time) when a passenger sends a trip request. Some mobiles can use 4G and others 5G. Full deployment of 4G/5G may not be achieved in some locations due to lack of network optimization on the operator side. Local accuracy can be affected in such cases.

      6. Race prices

        The range or package displayed is estimated by our Super Chauffeur platform for each race, taking into account the estimated distance (in km) of the race, the estimated duration of the race and the tariff level applied by the Driver, according to the scales adopted by the members of the Cooperative Society of Independent VTC Drivers (SCCVI) in assembly, within the limits of applicable law.

        The Application will determine at the end of the race the “effective calculated amount of the race” according to the real data of the race (final time, final distance, waiting costs, tolls) and according to the tariff level. For VTCs, the final price (based on the actual calculated amount of the journey) that will be invoiced to the Customer may not exceed the maximum of the initial price range, which is a guaranteed price.

        Notwithstanding the above, the final price of the trip could exceed the maximum price of the estimated range if, for example, there are waiting costs for the Driver at the pick-up point or if the Customer changes destination, such as the law requires it. If there are tolls, baggage and item fees, which are fees/taxes levied for access to certain roads, including bridges or tunnels, they will be added to the fare until at the maximum price of the estimated range of the race which not be exceeded.

        In the latter case, before the end of the trip, the Driver will enter in the Application the amount of the toll, suitcase, objects that he has advanced and which will appear on the receipt notified to the Customer by the Driver via the Application.

        In the event of high attendance, the price may be increased, according to the methods provided for by the Cooperative Assembly in assembly.

        A supplement per piece of luggage or object weighing more than 5 kg will be levied and the amount of which will be fixed by the members of the SCCVI.

      7. Payment of the race by the customer

        The “Fees” are defined as: the price of transport services including applicable taxes, waiting, cancellation and toll fees. The Customer may pay the Fees either by debiting the bank card registered in his Customer Account or directly with the Driver in cash.

        When payment is made by credit card via the Application, this payment is automatically transferred to the driver's bank account.

        A receipt containing all the information required by law will be automatically sent to the Customer as soon as possible and will be made available to the Driver on the Application. Drivers are legally required to keep receipts for at least 5 years. A valid bank card must be registered on the Application by the Customer when opening the Customer Account. When ordering a race, the Customer will select his method of payment, in cash or by credit card. If there are several saved cards, he will select the one he wants to use. With each race order, Super chauffeur will carry out on behalf of the Driver a pre- authorization on the Customer's bank card for the maximum amount of the price range. If the pre- authorization fails, the Driver will receive a notification that the ride has been canceled due to the Customer's card pre-authorization failure.

        If the Customer has selected the payment method in cash and the payment is not made at the end of the race (it is strongly recommended to cash the amount of the race before departure), it will be up to the Driver to find an amicable solution with the Customer or, where applicable, to take the necessary measures against the latter (complaint, etc.).

        The SCCVI will not be held responsible for this non-payment by the Customer and this sum will not be due by the SCCVI to the Driver.

      8. Driver Payments

        The Treasurer committee of the SCCVI will automatically pay into your bank account the sums collected during your races according to the decision of the members of the SCCVI in general assembly once/twice a week. Credit card charges are not passed on to you. You will be able to consult your statements at any time via your Application.

      9. Disclaimer

The SCCVI is required, under applicable law, to ensure that Drivers using the Application, web/CT have the authorizations and permits necessary for the exercise of their activity and must verify, to the extent that can reasonably be required of him, that the Driver uses a vehicle that meets legal requirements.

Within the limits authorized by the applicable laws, the SCCVI, its managers, employees or service providers cannot be held responsible for any loss or damage, direct or indirect, resulting from or related to your use of the Application/Web/CT or any service or content related to this Application, nor in general to any liability resulting from a minor fault. In particular, the Cooperative, and where applicable, cannot be held liable:

(I) any damage resulting from the use or inability to use the Application, including damage caused by malware, incompatible software, viruses or any inaccuracies or omissions of information from the Application , its content and related services.

(ii) Indeed, the Cooperative, and where applicable, does not guarantee that the Application and/or the associated services will meet your needs, will be complete, free of errors, omissions, defects or always available, timely, current, accurate and always accessible.

(ii) the use of electronic means of communication with the Application, Web/CT, in particular damage resulting from a failure or delay in the transmission of electronic communications, from a Malfunction of the Internet network or from other reception equipment preventing access to the Application, Incompatibility of the Application with other electronic means, interception or manipulation of electronic communications by third parties or by computer programs used for electronic communications and the transmission of viruses.

(iii) Acts, behaviors, attitudes or negligence of the Driver. Any complaint concerning the Transport Services provided by the Driver must therefore be addressed to him directly via the Application and it will be up to the Driver to take all the necessary measures (complaint, amicable solution, etc.). The SCCVI, and if necessary authorized by the latter, may suspend, withdraw the license, interrupt or modify all or part of the Application, web at any time and without notice, in particular for reasons of maintenance, force majeure or legal . The Application, web will inform you of this by means of a notification. You acknowledge that the SCCVI, and if necessary authorized by the latter, cannot be held responsible for such suspensions, modifications or interruptions of the Application.

Throughout the duration of the race, all guests are required to respect the rules of the road, in particular with regard to the wearing of seat belts. The user is required to follow the instructions issued by the SCCVI service provider. The SCCVI service provider is responsible for safety during the race. It is therefore forbidden to open the doors during the race, to throw objects out of the vehicle and/or to remove body parts from the vehicle or to shout during the race. If the user wishes to use the devices or

Equipment of the vehicle himself, he must follow the instructions provided by the SCCVI service provider. Smoking is prohibited in the passenger compartment of the vehicle. If the user or the guest does not comply with this instruction, he is obliged to pay the costs of cleaning the car and the compensation for the period during which the car could not be used. It is forbidden to eat in the car. The consumption and consumption of alcoholic beverages requires the prior agreement of the SCCVI provider.

10-8 Other supplements:

Waiting time for one-way journeys for one-way journeys, if the pick-up point is an airport or a train station (only for main line stations), the waiting time is a maximum of 60 minutes from scheduled pick up time, additional cost. But in case of delay or progress in the air or rail transport, the driver can adjust the transfer time according to the agreed time between the arrival time and the pick-up time provided for in the contract. Each additional minute of waiting is invoiced on the basis of a flat rate excluding tax taking into account the municipality concerned and the category of vehicle chosen.

Additional 10-9 Km for booking by the hour:

The hourly reservation includes the number of kilometers (per hour) as mentioned in the

Reservation form (or by phone). Additional kilometers will be subject to a supplement plus value added tax depending on the rates available in the municipality concerned and the category of vehicle selected.

  1. Taxation

    VAT: For drivers, the turnover ceiling for compulsory affiliation is

    CHF 100,000.-, now a driver making less than CHF 100,000.- in turnover can apply for voluntary affiliation if he has a lot of expenses subject to VAT that he could recover.

    The SCCVI does not intervene in any way in the process of realizing the turnover of the drivers.

    You accept:

    1. To comply with all your tax obligations related to the supply of

      Races, including any entry requirements, in accordance with applicable law;

    2. Provide the SCCVI (or, where applicable, one of its affiliated companies) with all useful tax information (for example, and without this list being considered exhaustive, a valid tax identification number belonging to you as well as all the information concerning your status VAT number).

    3. Inform SCCVI of any change in your tax status (including with regard to your VAT status) in writing, no later than 5 working days.

    4. And that you are responsible for your own social charges, taxes and levies, including on your own income, arising from the provision of the Races.

Notwithstanding anything to the contrary in these CSVI Member Terms of Service. The SCCVI may, in its reasonable discretion, depending on applicable tax and regulatory considerations, collect and remit

Taxes resulting from the provision of the Races and/or provide any member information directly to the relevant tax authorities, including on your behalf. And for your account.   1. Insurance and accidents.

    You will maintain motor vehicle liability insurance (suitable for Professional Transport of Persons and including protection against bodily injury and property damage to third parties) for all vehicles you use during the term of these Terms of Use, at the insurance levels required and imposed by the applicable regulations. If you are a commercial company, you must also take out the following insurance within limits equal to or greater than those required by the applicable legal provisions: Civil liability insurance which protects third parties against bodily injury and material damage and insurance against accidents at work in the to the extent required by applicable law. Within 7 days of our request, you will provide us with copies of all or part of the certificates of insurance. We may, at any time, verify your insurance coverage with insurance companies or third parties. If you are involved in a traffic accident while using our Services, which could give rise to an insurance claim, you must provide us, as soon as possible (and at the latest within 30 days), all necessary information and cooperate with our insurers in any investigation relating to this accident.

    1. Accident and loss of earnings insurance

To have accident and loss of earnings insurance, you can ask several insurance companies to cover you in the event of an accident and loss of earnings.

  1. Termination/ Resignation

    1. You are free at any time to use or terminate the SCCVI App/Web/CT Services (as applicable) and you may terminate these Terms and the App/Web/CT Services by closing your account.

    2. The member must present his resignation in writing to the recruitment committee of the SCCVI.

  2. Partial nullity

Any invalidity or unenforceability of any provision of these Terms of Use shall not affect the validity of the remaining provisions.

  1. In case of profit, how are they distributed?

    Each member (driver) will benefit from the work they do. The administrative committee of the SCCV will share the net profit of the SCCV with the member at the end of each year provided that the beneficiaries comply with the rules and obligations mentioned below:

    1. Be a member of the SCCVI

    2. Compliance with all membership provisions in the statute of the cooperative.

    3. Payment of the annual membership fee of the cooperative

    4. At least 80% of you have worked with SCCVI.

    5. Be up to date with the payment of AVS contributions, tax and VAT. Source of revenue for the SCCVI:

      1. Annual subscription of SCCVI members

      2. 25% net profit from Super Travel. (5% will be for the administrative committee)

      3. SCCVI profitable investments such as: Car rental, Shopping center operation, etc.

  2. Who will manage the cooperative (SCCVI)?

    The President of the SCCVI and the Board of Directors elected by the members ensure the proper execution of the major decisions taken at the general meeting.

    Regarding management, the cooperative will be managed by competent staff as in any company (operators, accountants, secretaries, etc.) with the possibility for employees to also be members for more motivation.

  3. Who will manage the application / Website / Call center?

Experienced team of software and hardware engineers Super Travel Cooperative Technologies, under the supervision of the administrative committee of the SCCVI.

Cooperative Technologies is responsible for all costs of the application, website, call center and advertising and communications with CSVIC's customers and service providers.

Super Travel Cooperative Technologies Source of Revenue:

  1. Receive 10% administrative fees from clients (which should give 25% of the net profit to the SCCVI)

  2. Advertising

  3. Joint venture with SCCVI and other partners.

Cooperative Technology has invested in the launch of the Super Travel app, website and call center and in all the necessary steps such as marketing, advertising and...

SCCVI will not be involved in the loss or profit of Cooperative Technologies.

All costs of CT's personal salaries, app, website, call center, advertising and marketing are the responsibility of CT.

  1. Intellectual Property

    You acknowledge that all intellectual property rights and other rights relating to the Application are the exclusive property of the Cooperative (or even of any possible subcontractor according to the agreements in force). These rights include rights relating to the Super Travel software, its databases,

    Trademarks, logos, domain names or other similar rights. These Terms of Use shall in no way be construed as transferring ownership of the Application or any element thereof or its content to Customers.

    Subject to your compliance with these Terms of Use, the cooperative grants you a limited, non- exclusive, non-sub licensable, revocable at any time and non-transferable license (i) to access and use the Application on your personal device in sole respect to your use of the Services, and (ii) access to and use of any content, information and related materials that may be made available to you through the Services, in each case solely for your personal use and not commercial.

    The Cooperative does not grant any right or license to use its Super Travel names, logos and product names associated with the Application and SUPER services.

    You may not (i) copy, redistribute, reproduce, record, transfer, perform or publicly display, broadcast or otherwise make available to the public any part of the SUPER Service or otherwise use the Super Travel Application or Service of any manner not expressly permitted by the Terms of Service or applicable law or in any other way that violates Super Travel's intellectual property rights, (ii) sell, rent or sublicense any part of the Super Travel Services, (iii) decompile, reverse engineer or disassemble the Services except as permitted by applicable law from time to time, (iv) insert links, mirror sites or framings of any part of the Services, (v) cause or launch any program or script for the purposes of data harvesting, indexing, data progression or data mining of any part of the Services or unduly burden or inhibit the operation or functionality of any part of the Services and, (vi) attempt to gain unauthorized access to or tamper with any aspect of the Services or related systems or networks.

    In the event of violation of this article, the Customer is liable to prosecution, in particular but not exclusively in the context of an action for infringement, in addition to the termination of the contract.

  2. Applicable law and competent courts

These conditions of use are subject exclusively to Swiss law, Geneva and your canton. Subject to mandatory legal provisions, any dispute relating to the APP/web/CT and these

The conditions of use, including their validity, their interpretation or their execution, will be, if necessary, in the absence of success of a prior amicable negotiation, submitted to the ordinary courts of the canton of Geneva.
